TalkAI — Terms & Conditions: Plain-Language Summary
Version 1.0 — 18 June 2026
This is a friendly, readable summary of our Terms & Conditions. It's here to help you understand the key points quickly. It is not the full agreement. The full, binding Terms & Conditions are available here: . If anything in this summary differs from the full Terms, the full Terms apply — except where the law gives you a right that must prevail.
---
The basics
- TalkAI is a business tool. We provide an AI voice receptionist that answers calls, routes them, transcribes and summarises them, books appointments, and sends messages. It's built for businesses, not for personal or emergency use.
- Who you contract with. South Africa & most countries: LLumins (Pty) Ltd (Trading as TalkAI). Germany/EU (where stated on your Order Form/invoice): Noki Group GmbH.
- It runs on shared cloud infrastructure and depends on third parties like Google Cloud, telephony carriers, and AI providers.
What you should know about the AI
- The AI is powerful but not perfect. It can mishear, misroute, mis-book, summarise things wrongly, or "hallucinate."
- You need to supervise it, keep your settings current, and check important outputs. Don't make it your only channel for emergencies.
- Tell your callers they're talking to an AI and that calls may be recorded and transcribed — and get any consent the law requires. This is your responsibility.
Phone numbers
- The free included number is for routing only — don't publish it or use it as your public number.
- To get a public / outbound / SMS / WhatsApp number, you must complete RICA (South Africa) or the equivalent KYC (Germany/EU). You're responsible for how your numbers are used.
Money
-
Fees are charged in advance and auto-renew. Taxes (VAT etc.) are extra.
-
Automatic overage top-ups are OFF unless you turn them on.
-
Refunds: generally none for unused time — but:
- EU/Germany consumers get a 14-day withdrawal right (full cooling-off, see the full Terms, Section 6A).
- Mandatory legal rights always apply.
- You can cancel future renewals any time.
Your data & privacy
- You own your data. For your call data we act as your processor; for our own billing/security/product data we act as a controller.
- We apply security measures (encryption, access controls), but no system is 100% secure.
- We don't use your identifiable data to train third-party public AI models without your agreement.
- Our binding data-processing terms (GDPR Article 28 / POPIA) and our subprocessor list are in the full Terms (Sections 15 & 21).
AI transparency (EU AI Act)
- Where the law requires, callers must be told they're interacting with AI.
- No prohibited or unlawful high-risk AI uses, and no unauthorised voice cloning or impersonation.
If something goes wrong
- Complaints: email us — we acknowledge within 2 business days and aim to resolve within 14 days (full Terms, Section 12A).
- Our liability is capped (full Terms, Section 11). We never limit liability for fraud, gross negligence, wilful misconduct, death or personal injury, or anything the law won't let us exclude.
- Disputes: South Africa — arbitration in Cape Town. Germany/EU — competent German courts, and you keep any mandatory right to your local courts.
Acceptable use (the short version)
- No fraud, spam, robocalling, caller-ID spoofing, harassment, or illegal use.
- No high-risk/regulated uses (medical, legal, financial, debt, emergency dispatch, etc.) without our written approval.
- Be respectful to our team — abuse can lead to suspension.
Referrals & affiliates
- Invite & Earn: earn account credits when businesses you refer become paying customers (subject to fraud checks; credits have no cash value).
- Affiliates: earn commissions on approved referrals; you must clearly disclose the relationship (e.g. "#ad") and follow advertising and marketing laws.
